6. Data Retention

We retain personal information only as long as necessary to fulfill the purposes described in this Privacy Policy, comply with legal and regulatory obligations (including those applicable to government contractors), resolve disputes, and enforce our agreements. Contact form submissions are typically retained for up to three (3) years unless a longer retention period is required by law or contract.

When personal information is no longer needed, we securely dispose of it in compliance with applicable law, including the Florida Information Protection Act (FIPA), Fla. Stat. § 501.171, which requires that customer records containing personal information be disposed of in a manner that protects against unauthorized access.

8. Data Breach Notification

In the event of a security breach affecting personal information, the Company will take the following steps in compliance with the Florida Information Protection Act (FIPA), Fla. Stat. § 501.171:

  • Notification Timing: We will notify affected individuals and the Florida Department of Legal Affairs within 30 days of determining that a security breach has occurred affecting 500 or more Florida residents

  • Notification Content: Notices to affected individuals will include: (a) the date, estimated date, or estimated date range of the breach; (b) a description of the personal information that was accessed or reasonably believed to have been accessed; (c) contact information for us, including a toll-free number, postal address, and email address; and (d) a description of steps we are taking to protect individuals from potential harm

  • Encrypted Data Exemption: Personal information that has been rendered unusable, unreadable, or indecipherable through encryption, truncation, or other appropriate means is exempt from FIPA breach notification requirements

  • Substitute Notice: Where the cost of individual notice would exceed $250,000, the number of affected individuals exceeds 500,000, or we do not have sufficient contact information, we may provide substitute notice through website posting and major statewide media

Nothing in this section limits any notification obligations under other applicable federal or state law.

9. Children's Privacy

The Site is intended for business and professional use and is not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq.

We employ reasonable age-screening measures consistent with the nature of our business-to-business Site to reduce the risk of collecting information from children. To the extent the Company sends commercial email communications, we comply with the Controlling the Assault of Non-Solicited Pornography And Marketing Act (CAN-SPAM Act), 15 U.S.C. § 7701 et seq. All commercial emails sent by the Company will:

  • Clearly identify the communication as an advertisement or promotional message where required
